Subrogated Recoveries

ANA has extensive experience in representing insurers in some of Australia’s largest and most complex losses across all industries, locations and sectors.

Subrogated recoveries require prompt attention upon the first notification of loss, as well as an early assessment to identify responsible third parties, establish negligence, and apply legislation that applies to the state or territory.

Recovery can often be a long-winded process, typically addressed once indemnity has been provided to a policyholder, thus losing valuable information in the process and subsequently prejudicing the likelihood of success. If subrogation is not in the forefront of the Insurer or Adjuster’s mindset at the commencement of a claim, it is common for recovery attempts to fail due to:

  • Disappearance of a Third Party
  • Causation / negligence not established to the required standard
  • Costs not substantiated to an appropriate level

In addition to the above, delayed recovery action can also lead to increased costs when attempting to retrospectively establish the loss, or the potential of a counter action from the Third Party where evidence may not be available for an adequate defence.

Should a potential recovery action be identified at first notification, the claim should be referred to the appropriate recoveries team or specialist, to work alongside the claims team and all involved parties.

The Expert Solution

The ANA Chase team has extensive experience in subrogated recoveries, with specialists across Motor, Property and Engineering portfolios.

Our specialists work with underwriters to identify avenues for recovery and establish a strategy from the outset of the claim, in order to maximise the chances of success and reduce the loss ratio of our clients.

Working in conjunction with all involved parties, ANA Chase will obtain and secure all required expert reports, images and CCTV footage, witness statements, and establish a clear quantum to be pursued.

Our team will promptly communicate with the Third Party and their representatives to establish liability and the loss, with our focus being the expedited return of funds back to the claim.
